A college student who suffered a neck fracture when he jumped into a pool during a party was awarded a $5,632,421 verdict by an Alachua County jury. The award was subsequently reduced to $1,126,484.22, reflecting the jury’s finding of negligence by the plaintiff himself, as well as the negligence of an apportionment defendant.
On March 17, 2017, plaintiff Jack Massey, 20, a college student, attended a promotional St. Patrick’s Day party at the Retreat, an apartment complex on University Avenue in Gainesville. Guests were encouraged to bring their own alcohol to the party. Before arriving at the party, Massey and his friend bought beer and alcoholic malt beverages from University Chevron.
