Eighth Circuit Rejects Student-Athlete’s ‘Unreasonable,’ Delayed Attempt to Revive Men’s Gymnastics Team

The U.S. Court of Appeals for the Eighth Circuit held that a University of Minnesota student-athlete’s attempts to reinstate the men’s gymnastics team were too little too late, finding he had waited an “unreasonable” amount of time in filing his motion for preliminary injunction.

In an April 5 opinion, the Eighth Circuit affirmed a district court’s decision to deny a motion for preliminary injunction filed by the plaintiff, Evan Ng, after determining that Ng’s delay in filing for the injunction undermined his claim of irreparable harm.
