Court Rejects Sam’s Club’s Motion to Nix Slip-and-Fall Case, Citing Question of Whether Danger Was ‘Known and Obvious’

A federal judge in Pennsylvania has denied Sam’s Club’s motion for summary judgment in a slip-and-fall case, concluding that a jury would need to resolve genuine issues of fact regarding whether the danger was known and obvious.

U.S. District Judge Susan Paradise Baxter of the Western District of Pennsylvania determined issues of fact remained regarding a slip-and-fall incident at a Sam’s Club in Erie, where Malissa Perry was seriously injured after falling on a floor mat.
