10th Circuit Revives Challenge to New Mexico Donor Disclosure Rules

The U.S. Court of Appeals for the Tenth Circuit revived a group’s First Amendment challenge to New Mexico political spending disclosure rules.

Judges Carolyn McHugh, Nancy Moritz and Harris Hartz said the free market think tank Rio Grande Foundation has standing to challenge a 2019 amendment to New Mexico’s Campaign Reporting Act, which requires political committees to disclose the names and addresses of donors if their contributions exceed a certain threshold during an election cycle.
