Like Anything Else in the Law, Technology Requires Balancing Risks and Rewards

Last month New York City implemented a new law restricting employers from using artificial intelligence (AI) to make employment decisions unless they follow certain guidelines. To comply with the law, employers must alert candidates that they will be subjected to the AI system, list the qualifications and characteristics sought by the system, and audit the system annually for biases.

This law reflects the risks and rewards lawyers, their clients, lawmakers, and regulators must balance with today’s technology. While a tool to help people do their jobs faster and better, technology—if unchecked—can lead its users or the public into problems, thus challenging the government to implement solutions without squelching innovation.
