Akin Gump Can’t Escape Tech Company’s IP Misappropriation Claims, Judge Rules

A legal tech developer’s claims that Akin Gump Strauss Hauer & Feld violated user agreements by assuming ownership of its proprietary software can proceed, a Washington, D.C., Superior Court judge ruled last week.

The latest development in the dispute over ownership rights of a legislation drafting software saw Judge Juliet McKenna on Feb. 15 rule that four of defendant Xcential’s counterclaims against the Am Law 100 firm—of breach of its license agreement, misappropriation of trade secrets, misappropriation of confidential information and breach of implied contract—could advance, while the tech company’s claim of slander of title was dismissed.
