In a 32-page concurring opinion, Judge Kevin Newsom of the U.S. Court of Appeals for the Eleventh Circuit, wrote about his experiment using generative AI-powered chatbots to define terminology that informed his analysis in an insurance appeal.

The detailed roadmap of how he used OpenAI’s ChatGPT to define the word “landscaping” in a case involving an inground trampoline caught attention of legal professionals far and wide. Judge Newsom anticipated this in his opinion: “Here’s the proposal, which I suspect many will reflexively condemn as heresy, but which I promise to unpack if given the chance,” he wrote, before encouraging other judges to explore the limits and capabilities of large language models (LLMs).
