A Miami attorney intends to move for reconsideration of a report and recommendation issued Saturday by a federal magistrate judge finding that William Fuller’s and Martin Pinilla’s objection to Joe Carollo and his wife’s homestead exemption claim should be overruled.
Jeffrey Gutchess, a partner at AXS Law Group, represents the plaintiffs, Fuller and Pinilla, who were awarded a $63.5 million verdict because the defendant, Miami Commissioner Carollo, violated their First Amendment rights. Afterward, on Jan. 9, a writ of execution was issued for the seizure of “goods and chattels, lands and tenements” in the district belonging to Carollo.
