An Illinois appellate court reversed a trial court’s decision on remand to compel arbitration on behalf of the Chicago Cubs Baseball Club, after an Associated Press photographer was injured at Wrigley Field, determining the trial court’s previous decision to deny the motion to compel was correct.
AP photographer Charles Arbogast fell and sustained injuries while taking photos on the field, leading him to sue the defendants for negligence and violation of the Premises Liability Act. The Cubs moved to dismiss the suit and compel arbitration, claiming Arbogast’s use of his media credential to enter the field constituted acceptance of the conditions, which are on the back of the credential and include a mandatory arbitration provision.
