A federal judge in Pennsylvania cleared the way for a former teacher’s First Amendment claims against a school district, finding the educator was wrongly accused of storming the U.S. Capitol after making posts on social media about attending the former president’s “Stop the Steal” rally on Jan. 6, 2021.

In a July 9 opinion, U.S. District Judge John M. Gallagher of the Eastern District of Pennsylvania concluded that posts on Facebook from the teacher, Jason Moorehead, about attending former President Donald Trump’s rally were made on his personal social media account and did not affiliate with the Allentown City School District.
