Some judges will encourage attorneys to administratively terminate a motion and refile it, if its time pending is nearing the six-month mark, claimed Nicholas Duston, a litigator at Norris McLaughlin in Bridgewater. He said this appears to be intended to improve the judge’s standing under the Civil Justice Reform Act.
