Pharmaceutical company AIM Immunotech and a group of shareholders seeking election to the company’s board have clashed repeatedly, ending up before a Delaware court more than once.

Where they do generally agree, attorneys for both sides confirmed on Thursday following questioning from Delaware’s Supreme Court justices, is that the Court of Chancery painted with an unnecessarily broad brush in the dispute over advance notice bylaws that’s triggered similar lawsuits from other corporations.
