For generative artificial intelligence (GenAI) models, which with a simple prompt, are capable of creating new text, images and audio, 2023 proved to be a seismic year. While the GenAI revolution has captured the collective imagination, this technology also poses threats to fundamental rights such as privacy, freedom from discrimination, and health and safety. GenAI has also given rise to the phenomenon of “deep synthesis” or “deepfake” content used to disseminate fake news and perpetrate fraud.

Leaders and legislative bodies worldwide have used their authority to harness GenAI’s transformative power and mitigate risks—albeit at different paces and with different priorities and approaches. This divergence is particularly evident when comparing the GenAI laws enacted in the People’s Republic of China (PRC) with the nascent efforts of President Biden and Congress to respond to these new challenges.
